1. I hereby ratify and affirm all of the agreements set forth in my subscription agreement, and agree to be bound by the terms thereof.
2. Without limiting the foregoing, I acknowledge and agree that (a) all of the information and content provided through PermitLocator.com (collectively, Content) has been provided to the AGC of St. Louis by third parties; (b) the AGC of St. Louis tries to provide Content through PermitLocator.com that is current and accurate, but the Content is not warranted by the AGC of St. Louis in any respect; (c) any and all express or implied warranties (including, without limitation, any warranties of merchantability or fitness for any particular purpose) regarding the accuracy, adequacy, quality or completeness of the Content are hereby expressly disclaimed; (d) the subscriber remains responsible for verifying the accuracy, adequacy, quality and completeness of the Content directly with all applicable permitting agencies; and (e) the subscriber, on behalf of itself and its affiliates, officers, directors, managers, and employees, hereby releases the AGC of St. Louis from any and all claims, losses, demands, liability, causes of action or damages of any kind whatsoever arising out of or relating to the Content (including, without limitation, direct, indirect, incidental, or consequential loss or damages, compensatory damages, loss of profits, or data, or otherwise), except to the extent caused by the gross negligence or intentional misconduct of the AGC of St. Louis. IF APPLICABLE LAW DOES NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE MAXIMUM LIABILITY OF THE AGC OF ST. LOUIS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SUBSCRIPTION AGREEMENT AND THE CONTENT SHALL BE THE PRICE PAID FOR THE SUBSCRIPTION AS PROVIDED IN THE SUBSCRIPTION AGREEMENT.
